按照中国国籍法，如果父母是中国人，孩子就是中国人。但如果孩子在美国出生，按美国国籍法，则会自动获得美国国籍。这样就会形成国籍冲突的情况。这样的小孩回国，是需要在大使馆办理旅行证。在国内被认定为中国人，出国则需要在公安出入境部门办理出入境通行证。
